7. TERMS OF
PAYMENT
7.1 By
T/T:
Down payment, not less than *0% of the total value of this PI,
shall be remitted to the seller’s account within 5 working days
after signing this contract by both parties and the balance shall
be remitted to the seller ahead of *4 working days before shipment.
If the time that the balance can’t be remitted to the seller
exceeds *0 days from that date of receipt of down payment, the
seller has the right to handle the commodity freely and to keep the
down payment as compensation to the seller.
SERVICE AND WARRANTY
Policy
The
manufacturer agrees to supply to the distributor all required
tools, manuals, software and technical knowhow together with
updated technical literature at all times, assist in training and
upgrading skills of distributors mechanics in the
territory.
Normal
warranty:
The warranty period is twelve
(*2) months or a mileage of **0,**0 km( tractor and cargo truck and
so on) or *0,**0 km( tipper, concrete mixer, water tank and oil
tank and cross-country truck and so on), whichever comes first from
the date of shipment in the bill of lading. If the vehicle has
quality issues within the warranty period, the seller will supply
the replaceable spare parts to the distributor under SINOTRUK claim
application procedure. All the local charges including customs
duties shall be undertaken by the Buyer.
One-off
Warranty:
The seller
providesthe
buyer spare parts
valued2%
of contract on FOB basis free of charge as one-off
warranty.The
sellershall never
be responsible for
the warranty of vehicles in future. However,batch
quality problem
is excluded.The buyer
shall be
responsible forthewarranty
of vehicles for end users.The
sellerfurther warrants
a continuous supply of spare parts on all items sold and undertakes
to deliverthe buyer
the
needed spare parts immediately upon receipt of
payment. If the buyer
fails to fulfill warranty for end users, all spare parts for
warranty’s purpose shall be returned to the seller.
Batch quality
failure within warranty means: When the quantity of one order is
more than *0 units, the same parts or components occur quality
problem and the reason to cause quality problem is also same, the
quantity of malfunction trucks is more than *0% of this order (if
the quantity is more than *0 units) or *0% of this order (if the
quantity is more than *0 units)
